the question everyone has come to dread; "have you had anything to drink?"
That sinking feeling in your chest as you see the flashing lights turn on, the frantic thinking of when you had your last drink, the nervousness of answering the officers questions. Then the embarrassment of getting arrested, handcuffed, and hauled off to jail. You were alone at that time, but I am here to help you the rest of the way.
South Dakota has some of the toughest DUI laws in the nation. If you have been arrested for drunk driving, you face the possibility of significant penalties, including jail time, court ordered alcohol treatment, daily PBTs under the 24/7 program, driver's license suspension, probation and significant court fines. If you have been charged with felony DUI, you could even be sentenced to serve time in prison. Do not plead guilty to a DUI charge before speaking with an attorney. You may not know or understand how a conviction may affect your future, and many people incorrectly assume that they have no defense or options available to them related to their charges.
Even when your BAC is over the legal limit, there may be ways that I can make a positive difference in your case. I will closely examine the nature of your traffic stop as well as the evidence gathered by law enforcement to identify key issues which could impact your case:
We will look to these and other issues to determine if a dismissal of the charge is possible, if we can fight your charges effectively at trial, or if a favorable plea agreement can be obtained that minimizes penalties arising from your charges. I will work hard to pursue the most favorable outcome possible for each client I serve.
